1.1 These terms of use, together with the Privacy and Cookies Statement (collectively, the “Terms of Use”), set out the terms on which Porto Tours (together with its affiliates and subsidiaries: “Porto Tours,” “we,” “us,” “our”) provides services (the “Services”) through its partners booking platform (the “Platform”) as made available through our website www.portotours.co.uk, together with all related domains, white-label and affiliate sites, mobile properties, and related applications, collectively referred to as the “Website”) and over the telephone. When we refer to “you,” we mean any person who accesses or uses the Services. Porto Tours is not a travel or tour agency, nor is it a supplier of tours, activities, or experiences. When you make a booking, you are using the Partner Platform to contract with third-party suppliers. Porto Tours is part of a network of trusted travel partners (hereinafter the “Group”).
1.2 These Terms of Use govern your relationship with us regarding your use of the Services, including any bookings you make for tours, tickets, attractions, activities, and/or experiences (described in these Terms of Use as an “Experience”) advertised on the Website and made available by a third-party supplier (each, a “Product”).
1.3 By using or accessing the Services, making a booking (“Book,” “Booking”), and/or creating an account on the Partner Website (a “Account”), you agree to be bound by these Terms of Use without modification. You represent that you have read and understood them. In all Booking arrangements, the person making the Booking is deemed to have accepted these Terms of Use on behalf of all persons named in the Booking.
1.4 We may update or modify these Terms of Use at any time. Your continued access or use of the Services after such changes signifies your acceptance of the updated Terms of Use. We will note the date of updates at the top of this page, and the updated Terms of Use will take effect upon posting. It is your responsibility to review the most current version of the Terms of Use periodically. If you do not wish to accept any changes, you may contact us to close your Porto Tours Account and cease using the Services. See Section 22 for more details.
1.5 THE WEBSITE MAY CONTAIN TRANSLATIONS POWERED BY GOOGLE. GOOGLE DISCLAIMS ALL WARRANTIES RELATED TO THE TRANSLATIONS, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF ACCURACY, RELIABILITY, AND ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.
2.1 As a condition of your use of the Services, you represent and warrant that (i) all information you provide is true, accurate, current, and complete, and (ii) you are at least 13 years old. Porto Tours does not knowingly collect information from anyone under 13.
2.2 Your use of the Services is permitted only for personal, non-commercial use and/or to make legitimate requests to book Products. You agree not to use the Services for speculative, false, or fraudulent requests or Bookings.
2.3 You further represent and warrant that you (a) are not currently suspended and have not previously been banned by Porto Tours from using the Services; (b) are not acting on behalf of a competitor of Porto Tours; (c) will not create more than one Porto Tours Account; and (d) have full power and authority to enter into this legally binding agreement without violating any other agreement to which you are a party.
2.4 We retain the right to deny access to the Services to anyone at any time and for any reason, including violation of these Terms of Use.
2.5 In accessing or using the Website, you may encounter content that is offensive, indecent, inaccurate, objectionable, or otherwise inappropriate. Porto Tours does not endorse such content and cannot vouch for its accuracy. You access and use the Website at your own risk.
3.1 You may need to create a Account to use certain features on the Partner Website, including making a Booking. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.2 Your Account is for personal use only. You may not impersonate someone else, create an account for another person, or create multiple accounts.
3.3 We may terminate or suspend your account or access to the Services at our sole discretion, without notice or liability.
3.4 You may terminate your account at any time by contacting us to request closure.
3.5 If you are a consumer in the EU or UK, you retain certain mandatory consumer rights. Nothing in these Terms of Use affects those rights.
3.6 AS A USER OF THE SERVICES, YOU UNDERSTAND AND AGREE THAT, TO THE EXTENT PERMITTED BY APPLICABLE LAW: (1) NEITHER LISBON TOURS NOR ITS AFFILIATES WILL HAVE ANY LIABILITY TO YOU OR OTHERS FOR UNAUTHORIZED BOOKINGS MADE USING YOUR ACCOUNT; AND (2) THE UNAUTHORIZED USE OF YOUR ACCOUNT COULD CAUSE YOU TO INCUR LIABILITY TO BOTH LISBON TOURS AND OTHER USERS.
4.1 The content and information on the Website (collectively, “Website Content”) are proprietary to Porto Tours. You agree not to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any Website Content without prior written permission.
4.2 You agree not to:
a. Use the Website for commercial or unlawful purposes.
b. Access, monitor, or copy Website Content using automated means or manual processes without our express written permission.
c. Violate restrictions in robot exclusion headers or bypass measures to prevent access to the Website.
d. Take actions that impose an unreasonable load on our infrastructure.
e. Deep-link to any portion of the Website without permission.
f. “Frame” or “mirror” any part of the Website without authorization.
g. Attempt to modify, decompile, or reverse engineer any software.
h. Use the Website to harass, threaten, or interfere with another user’s experience.
i. Submit spam, chain letters, or other mass messaging.
j. Promote bigotry or discrimination.
k. Violate third-party rights, including intellectual property rights.
l. Submit illegal or harmful content.
5.1 By using the Website, you agree to receive electronic communications from us, including emails and in-app notices. You may unsubscribe from marketing emails, but we may still send non-marketing messages related to your Bookings.
5.2 We may share information with companies in the Group to provide you with special offers, products, and services.
6.1 Users may contribute content to the Website, including reviews, photos, and comments (“User Content”). We may use User Content in various ways, including displaying it on the Website or creating derivative works.
6.2 By submitting User Content, you grant Porto Tours a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute it.
6.3 Porto Tours may display advertisements adjacent to your User Content without compensation.
6.4 You are solely responsible for your User Content and assume all risks associated with it.
6.5 Porto Tours reserves the right to remove or restrict User Content that violates these Terms of Use.
7.1 The Website may contain links to third-party sites. These links are provided for reference only, and Porto Tours does not endorse or control these sites.
7.2 You are responsible for ensuring that any links or software you access are free of viruses.
8.1 Software from the Website is subject to export controls. You agree not to download or export software in violation of applicable laws.
8.2 Any software provided on the Website is owned by Porto Tours or its affiliates and is protected by copyright laws.
8.3 Reproduction or redistribution of the software is prohibited.
9.1 The Website and its content are owned by Porto Tours. All rights reserved.
9.2 Porto Tours operates on a “notice and takedown” basis. If you believe content infringes your copyright, please follow our Copyright Complaint Policy.
10.1 Porto Tours provides the Platform to facilitate contracts between you and third-party suppliers. Your contract for a Product is directly with the supplier.
10.2 Suppliers may be businesses or consumers. If you are a consumer in the EU or UK, you may not enforce consumer rights against a supplier who is also a consumer.
10.3 Porto Tours acts as a disclosed agent for suppliers. The provision of Products is subject to the supplier’s terms and conditions.
10.4 By making a Booking, you warrant that you are at least 18 years old and have the legal authority to enter into agreements.
11.1 Prices are quoted per person unless otherwise specified.
11.2 Prices are based on local tariffs and exchange rates at the time of quoting.
11.3 Prices do not include local taxes, fees, or additional expenses unless specified by the supplier.
11.4 Full payment is required to make a Booking, unless otherwise stated.
15.1 Once a Product is purchased, your Booking cannot be changed or cancelled with a refund unless stated otherwise in the Product’s terms.
15.2 The standard cancellation policy allows changes or cancellations up to 24 hours before the start time of the Booking.
15.3 Some Products are non-refundable. Check the cancellation policy in the Product listing before Booking.
18.1 Porto Tours is not liable for inaccuracies, errors, or omissions in the information provided on the Website.
18.2 Porto Tours is not liable for the acts, omissions, or negligence of suppliers.
18.3 Porto Tours’ liability is limited to $100
23.1 No joint venture, partnership, or employment relationship exists between you and Porto Tours.
23.2 These Terms of Use are governed by the laws of United Kingdom
23.3 If any provision is found invalid or unenforceable, the remaining provisions remain in effect.
23.4 These Terms of Use constitute the entire agreement between you and Porto Tours.
